TERMS AND CONDITIONS OF SALE

Effective as of 06/19/2024

ARTICLE 1 – Scope

These Terms and Conditions of Sale ("T&Cs") apply, without restriction or reservation, to all sales concluded by the company LES NICOLETTES, SARL with a share capital of €1,000, registered with the Narbonne Trade Register under No. 987 778 057, with its registered office at 4 Rue de la Forge, 11330 Villerouge-Termenès, France.

The T&Cs apply to non-professional buyers ("the Customer") who purchase products ("the Products") on the website: www.lesnicolettes.com

The products sold include, in particular: jewelry, accessories, and textiles. The essential characteristics are presented on the website. The Customer is required to review them before making any purchase.

Placing an order for Products implies full and unconditional acceptance by the Customer of these T&Cs. These take precedence over any other document.

The T&Cs are accessible at any time on the website. The Customer accepts the T&Cs by checking the box provided for this purpose during the online ordering process.

Sales are made for mainland France, Réunion Island, and certain European Union countries. For orders outside the EU, the Customer is the importer. Taxes or duties may apply.

ARTICLE 2 – Prices

Prices are indicated in euros, all taxes included (VAT). They do not include shipping costs, which are billed in addition.

The Seller reserves the right to change prices at any time. The applicable price is that in effect at the time the order is validated.

An invoice is provided upon delivery.

ARTICLE 3 – Orders

The Customer selects the Products, adds them to the cart, fills in their details, and validates the order before payment.

The order is only final after full payment. The Seller reserves the right to refuse any order in the event of a prior dispute.

The Customer can track their order via their personal account.

ARTICLE 4 – Payment

Payment is secure (credit card, bank transfer, or PayPal). It is due in full at the time of order.

Bank details are encrypted via a PCI-DSS compliant provider (Shopify Payments or other).

The Seller will only ship the Products after actual receipt of payment.

ARTICLE 5 – Delivery

Delivery in France, Réunion Island, and certain European Union countries. Estimated times: 1 to 10 business days.

The Seller strives to meet the indicated deadlines. If the deadline is exceeded by more than 7 days, the Customer may cancel the order in writing.

Products travel at the Seller's risk, unless the Customer chooses their own carrier. In that case, the Seller's liability ends upon handover to the carrier.

Any claim must be made within 48 hours of delivery.

ARTICLE 6 – Transfer of ownership

Transfer of ownership occurs only after full payment.

ARTICLE 7 – Right of withdrawal

The Customer has 14 days to exercise their right of withdrawal, without giving any reason.

To do so, simply send an email to: lucie@lesnicolettes.com stating your intention to return the item and your order number. We will then provide you with the return address and instructions to follow.

Products must be returned in their original condition, complete (packaging, accessories, instructions, etc.).

Return shipping costs are the Customer's responsibility.

Refund is made upon receipt of the return, via the original payment method used.

ARTICLE 8 – Legal guarantees

The Products are covered by:

The legal guarantee of conformity
The legal warranty against hidden defects

Applicable conditions are those set by the Consumer Code and Civil Code.

Return shipping expenses will be refunded upon presentation of a receipt.

ARTICLE 9 – Personal data

The data collected are necessary for the management of orders and deliveries.

They are processed securely, are not resold, and are kept for 5 years.

ARTICLE 10 – Intellectual property

All website content is protected. Any reproduction, even partial, is prohibited.

ARTICLE 11 – Applicable law

The T&Cs are governed by French law. In the event of a translation, only the French version is legally binding.

ARTICLE 12 – Disputes

Competent courts in the event mediation fails.

APPENDIX: Withdrawal form

This form is not required. To exercise your right of withdrawal, simply send us an email at: lucie@lesnicolettes.com indicating your order number. We will provide you with the return address and instructions to follow.
